Pursuant to subsection (1) of Section 464.203, Florida Statutes, you are being notified that effective April 6, 2012, Certified Nursing Assistant applicants who successfully pass the required background screening pursuant to s. 400.215 or s. 408.809 within 90 days before applying for a certificate to practice and the person's background screening results are not retained in the clearinghouse created under s. 435.12, the board shall waive the requirement that the applicant successfully pass an additional background screening pursuant to s. 400.215.
Level II statewide and national criminal background screenings are conducted pursuant to Chapter 435, F.S., and Section 408.809, F.S., which require fingerprinting, and are performed by the Florida Department of Law Enforcement and the Federal Bureau of Investigation. The results are reviewed for disqualifying offenses in Sections 435.04 and 408.809, F.S., to determine whether to grant a certification and, where deemed appropriate, an exemption for employment.
Applicants who successfully passed a level II screening by one of the agencies listed below within 90 days of their application for certification are not required to be re-screened:
Department of Children and Family Services; Agency for Health Care Administration; Department of Elderly Affairs; Department of Health; Agency for Persons with Disabilities; or Department of Juvenile Justice.
The Department of Health is in the process of developing business procedures with Prometric, our Information Technology Department (IT) and our sister agencies to fully implement the provisions of this law.
